Agreement to Terms

By accessing or using Baby Magic ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Eligibility and Age Requirements

You must be at least 18 years old to use this Service.

  • You must be a parent or legal guardian of any child whose photos you upload
  • You confirm you have the legal right to use and share the images you upload
  • You represent that you are of legal age to form a binding contract

This Service is NOT intended for use by children under 13.

Permitted Use

What You Can Do

  • Upload photos of your own children (with proper parental/guardian rights)
  • Create AI-generated dance videos for personal, non-commercial entertainment
  • Download and privately share your generated videos
  • Use the Service in accordance with applicable laws

What You Cannot Do

  • Upload photos of children for whom you are not the parent/guardian
  • Upload photos without proper consent from all depicted individuals
  • Use the Service for any commercial purposes without written permission
  • Attempt to reverse engineer, copy, or steal our technology
  • Upload inappropriate, offensive, or illegal content
  • Share or distribute others' content without permission
  • Use the Service to harass, abuse, or harm others
  • Create deepfakes or misleading content intended to deceive
  • Violate any applicable laws or regulations

Content Guidelines and Child Safety

Prohibited Content

You may NOT upload content that:

  • Contains nudity or sexually suggestive material
  • Depicts violence, abuse, or harm to children
  • Is intended to harass, bully, or intimidate
  • Violates anyone's rights (copyright, privacy, etc.)
  • Contains hate speech or discriminatory content
  • Promotes illegal activities
  • Is misleading or fraudulent

Violation of these guidelines may result in immediate account termination and legal action.

Your Rights and Ownership

Your Content

  • You retain all ownership rights to photos and videos you upload
  • By uploading content, you grant us a limited license to process and generate videos
  • This license expires when your content is automatically deleted (after 7 days)
  • You can delete your content at any time

Generated Videos

  • Generated videos are for your personal use only
  • Videos contain a watermark indicating they are AI-generated
  • You may share videos privately but cannot claim they are authentic dance performances
  • Commercial use requires separate written permission

Our Intellectual Property

  • Baby Magic's technology, design, and AI models are our proprietary property
  • You may not copy, modify, or create derivative works based on our Service
  • Our brand, logos, and trademarks are protected

Data and Privacy

Automatic Deletion

  • All uploaded photos are automatically deleted after 7 days
  • All generated videos are automatically deleted after 7 days
  • You can manually delete content at any time

No Training on Your Data

  • We do NOT use your uploaded photos to train our AI models
  • Your child's images remain private and are never shared
  • We do not create public galleries or databases of children's photos

Data Security

  • We use industry-standard encryption and security measures
  • We comply with COPPA, GDPR, CCPA, and other privacy laws

Payment and Refunds

Credits System

  • Our Service operates on a credit-based system
  • Credits are purchased through secure payment processing (Stripe)
  • Credits are used to generate videos based on duration and quality

Refunds

  • If video generation fails, credits are automatically refunded
  • No refunds for successfully generated videos
  • No refunds for unused credits (credits do not expire)
  • Subscription cancellations do not entitle you to refunds for prior periods

Pricing Changes

  • We reserve the right to change pricing with 30 days' notice
  • Existing subscriptions honor the original price until renewal

Service Limitations

Entertainment Only

  • Generated videos are for entertainment purposes only
  • Videos are AI-generated and not real dance performances
  • Videos include watermarks indicating AI generation
  • Do not misrepresent AI videos as authentic footage

No Guarantees

We do not guarantee:

  • Uninterrupted or error-free service
  • Specific quality outcomes for all photos
  • Compatibility with all devices or browsers
  • Permanent storage of your content (7-day retention only)

Service Changes

We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time
  • Change features, pricing, or terms with reasonable notice
  • Refuse service to anyone for any reason

User Conduct and Enforcement

Monitoring

  • We reserve the right to review content for compliance
  • Automated systems may flag potential violations
  • We do not routinely monitor private content

Enforcement

If you violate these Terms, we may:

  • Issue warnings
  • Suspend or terminate your account
  • Delete violating content
  • Report illegal activity to authorities
  • Take legal action for damages

Appeals

If your account is suspended, you may contact us to appeal the decision.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Baby Magic shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or use
  • Service interruptions or errors
  • Third-party actions or content
  • Any damages exceeding the amount you paid us in the past 12 months

Indemnification

You agree to indemnify and hold Baby Magic harmless from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of others
  • Content you upload or create

Governing Law and Disputes

Jurisdiction

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law provisions.

Dispute Resolution

  • If unresolved, disputes will be settled through binding arbitration

Account Termination

  • All your data will be permanently deleted within 7 days

By Us

  • Engage in fraudulent activity
  • Upload prohibited content
  • Are inactive for extended periods

Severability

If any provision of these Terms is found invalid, the remaining provisions continue in full effect.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Baby Magic.
